Paul Ogunde specialises in wide range of disputes before the High Court, Court of Appeal, Supreme Court, statutory tribunals and arbitrations arising from insolvency proceedings, enforcement of securities, tax , employment  , constitutional and administrative law , intellectual property , landlord and tenancy agreements among other areas  . He has been ranked as a leading disputes lawyer by the Chambers Global Guide, IFLR 1000 and Legal 500. He qualified as an advocate in 2003 and joined Walker Kontos in 2007

He has litigated landmark cases including: -

  • Representing the Law Society of Kenya, Kenya’s Bar Association against the Kenya Revenue Authority, in overturning regulations that required Capital Gains Tax to be paid before property was transferred.

  • Representing the Administrators of ARM Cement PLC (Under Administration) in a wide range of disputes in the insolvency affecting its subsidiaries in Kenya, Tanzania, Rwanda, and South Africa leading to substantial recoveries for lenders and other creditors.

  • Representing a major global brand in a suit brought by its local distributor (in which the global brand was a minority shareholder but with management rights) of over 40 years seeking to prevent it from appointing new distributors on the basis of, inter alia, a novel claim that appointing a new distributor amounted to unlawful corporate expropriation of an asset of a Company  by a dominant shareholder to the detriment of other shareholders .

  • Successfully representing a South African bank and its local affiliate in proceedings against the Government of Kenya when, the Government of Kenya in an unprecedented move, sought to restrain enforcement of securities held by the banks over a wind farm. This led to a settlement and progression of a receivership over the wind farm.

  • Representing a pan African telecom operator in proceedings instituted at the Kenya Communications Appeals Tribunal and the High Court of Kenya to restrain the Licensing of the Second National Fixed Line Operator resulting in the commencement of negotiations that led to the Communications Commission of Kenya and the Government of Kenya agreeing to release to the client frequencies that had been withheld which led to the client rolling out its cellular network.

  • Acted for a leading security services provider in overturning a decision of the High Court, (in the Court of Appeal), that had held that employers of security guards, guarding cash in transit, were required to provide the guards with bullet proof vests.

Paul is also active in matters affecting litigation in courts and has participated in many bar bench initiatives and was for a long time in his earlier years in practice an active member of the Milimani Commercial Courts Working Committee which was crucial in settling the operations of the commercial courts.
